OBJECTIONS TO THE SHRINKAGE OF ESZ DUE TO PROCEDURAL LAPSE FROM MINISTRY OF ENVIRONMENT, INDIA

 

  • KBR very well qualifies to be on this list if we see the chronological order of how the failure has been on the part of MoEF to declare ESZ and this cannot give liberty for the State Government to file a fresh proposal that too with such contradicting terms.  It is evident that the lapse was clearly to give way to the State Government to accommodate the project. 

  • Ideally, MoEF should have declared ESZ as per the proposal published on 18.12.2015 where there were no objections from citizens whatsoever. This Notification has more than enough objections which citizens are not willing to accept.

 

The chronological event on the ESZ proposal to validate is as follows:

 

  • Dated: 30.05.2015

    • A Government Order was passed by State Government giving in-principle approval for the constructing multi-level flyover at six junctions of KBR Park, amongst others.  

 

  • Dated: 08.09.2015

    • Administrative sanction for the multi-level flyover at different road junctions spread across the city. 

 

  • Dated: 18.12.2015

    • The State Governments proposal on declaring 25-30 mtrs i.e., the entire walkway as the Eco-Sensitive Zone was published in Gazette by the MoEF. 

  • Dated: February 16, 2016

    • The statutory period to file objection to the ESZ proposal published elapsed. 

 

  • Dated: April, 2016

    • Citizen movement started to protect the KBR Park wherein the major concerned raised was that the walkway acts as a buffer zone to KBR Park.  

 

  • Dated: 19.05.2016

    • The Principal Chief Conservator of Forest files an objection with MoEF stating that to accommodate the SRDP project the ESZ should be reduced from 25-30 mts to 3-7 mts.  

 

  • Dated: 30.05.2016

    • The 17th expert committee meeting was held wherein they took note of the proposal published, objection filed by Principal Chief Conservator and matter pending before NGT and Hon'ble High Court and the stay order for not cutting of trees.  The conclusion of the said meeting is hereunder:

  • "Since all these concerns have not been addressed in the proposal of the State Government, the proposal was deferred until a response is received from the State Government on the aforesaid issues"

  • Dated: 09.03.2017

    • The State Government filed another objection asking MoEF to declare it as a zero eco-sensitive zone similar to Guindy National Park. 

 

  • Dated: 15.06.2017

    • Due to the completion of 545 days the draft notification period lapsed and MoEF asked the State Government to file a fresh proposal.
